These Terms of Service ("Agreement") govern the use of the website operated by Image Lab Photography LLC, doing business as PhotoPlace Gallery ("PhotoPlace Gallery," "we," "our," or "us"). By accessing or using the services provided by PhotoPlace Gallery ("Site"), including but not limited to viewing, purchasing, submitting photographs, participating in exhibitions, or accessing exhibition calls, you agree to be bound by the terms and conditions set forth in this Agreement.
If you do not agree to these Terms, please do not access or use the Site.

2. Information Collection and Use
a) Information Collected
We collect information that you voluntarily provide when creating an account, submitting work for exhibition consideration, purchasing products or services, completing exhibitor forms, or otherwise communicating with PhotoPlace Gallery.
b) Use of Information
The information we collect is used to:
- Manage your account and submissions
- Process purchases and exhibition participation
- Communicate regarding current and upcoming exhibitions and events
- Provide updates related to PhotoPlace Gallery programs and services
If your work is selected for exhibition, images associated with that exhibition may be retained indefinitely as part of PhotoPlace Gallery's permanent exhibition archive.
c) Retention of Images
Selected images may be retained indefinitely as part of the gallery's historical archive. Images not selected for exhibition will be permanently deleted from our servers within a reasonable period following the completion of the jury process.
You retain all intellectual property rights to your submitted images, subject to the limited license granted in Section 3 of this Agreement.
d) Third-Party Sharing
We will not sell, rent, or otherwise disclose your personal information except as necessary to:
- Process transactions,
- Provide requested services,
- Fulfill shipping requests, or
- Comply with applicable law.
3. License to Use Images
a) Grant of License
If your work is selected for exhibition, you grant PhotoPlace Gallery a non-exclusive, royalty-free license to use, reproduce, and display the selected image(s) solely for the following purposes:
- Reproduction in printed and digital exhibition catalogs;
- Display on the PhotoPlace Gallery website and exhibition pages;
- Promotion of current and future exhibitions through social media, email newsletters, press materials, and other gallery-related communications.
Credit will be provided to the photographer whenever reasonably feasible.
b) Rights to Images
You retain full ownership and copyright of your submitted images. Nothing in this Agreement transfers ownership of your work to PhotoPlace Gallery.
c) Revocation of License
You may revoke permission for future promotional use of your selected images by notifying PhotoPlace Gallery in writing. However, revocation shall not affect materials already produced or distributed, including exhibition catalogs, archived exhibition webpages, social media posts, press materials, email campaigns, and other documentation associated with ongoing or completed exhibitions.
4. Artist Warranties and Eligibility
By submitting work to PhotoPlace Gallery, you represent and warrant that:
- You are the creator of the submitted work or otherwise possess all necessary rights and permissions to submit it;
- The submitted work does not knowingly infringe upon the copyrights, trademarks, privacy rights, publicity rights, or other intellectual property rights of any third party;
- You have obtained any necessary permissions or model releases for recognizable individuals depicted in the work;
- The work submitted is your own original creation;
- The information you provide to PhotoPlace Gallery is accurate and complete.
PhotoPlace Gallery reserves the right to disqualify submissions, remove work from exhibition, refuse service, or terminate user accounts if these representations are found to be false or misleading.
5. Account Access and User Data
a) Account Information
You may create an account to participate in exhibitions and communicate with PhotoPlace Gallery. Information provided during registration will be stored securely and used solely for the purposes described in this Agreement.
b) Access to Your Data
You may access, update, or modify your account information by logging into your profile.
c) Deletion of Data
Upon request, PhotoPlace Gallery will delete personal information associated with your account. Please note that deleting your account may affect your ability to access prior submissions and participate in future exhibitions.
6. Email Communication
a) Email Services
We use third-party email service providers to send communications regarding exhibition calls, events, promotions, and other PhotoPlace Gallery-related updates.
By creating an account, you consent to receiving these communications unless you opt out.
b) Opt-Out
You may unsubscribe at any time by clicking the unsubscribe link included in our emails or by contacting us directly at [email protected].
7. Cookies and Analytics
a) Analytics
We use analytics tools, including Google Analytics, to collect anonymous information about how visitors use the Site. This information helps us improve the user experience.
b) Cookies
By using the Site, you consent to the use of cookies as described in this Agreement. You may disable cookies through your browser settings.
c) Third-Party Policies
Google's use of information collected through its services is governed by Google's Privacy Policy.
8. Payment Processing and Security
a) Payment Processing
PhotoPlace Gallery utilizes third-party payment processors, including Stripe, to process transactions.
b) Security
Payment information is transmitted securely using encrypted systems maintained by the payment processor. PhotoPlace Gallery does not store complete credit card information and does not have direct access to your credit card number.

9. Sharing and Disclosure of Information
a) Shipping Services
We utilize third-party shipping providers to deliver artwork and purchased items.
These providers are authorized to use personal information only to the extent necessary to provide the requested services and are subject to their own privacy policies and terms of service.
10. Artwork Insurance and Transit
PhotoPlace Gallery maintains insurance coverage for artwork while it is in the gallery's possession and on display as part of an exhibition.
Artists remain solely responsible for insuring their work during transit to and from the gallery.
We strongly encourage artists shipping original, irreplaceable, or high-value work to purchase appropriate shipping insurance and retain tracking information for their records.
While PhotoPlace Gallery takes reasonable care in handling all artwork entrusted to us, we cannot assume responsibility for loss, theft, or damage occurring during shipment, including delays, mishandling, or other actions by third-party shipping carriers.
11. Limitation of Liability
To the fullest extent permitted by law, PhotoPlace Gallery, Image Lab Photography LLC, and their owners, employees, contractors, volunteers, and representatives shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from:
- Use of the Site;
- Participation in exhibitions;
- Submission of artwork;
- Shipment of artwork; or
- Participation in PhotoPlace Gallery programs and events.
PhotoPlace Gallery reserves the right to modify exhibition schedules, jurors, awards, programming, gallery hours, submission deadlines, and other exhibition details when circumstances require.
In the event of circumstances beyond our reasonable control, including but not limited to natural disasters, public health emergencies, utility interruptions, acts of government, labor disputes, severe weather, shipping delays, or other force majeure events, PhotoPlace Gallery shall not be liable for resulting changes, delays, cancellations, or interruptions.
12. Reservation of Rights
PhotoPlace Gallery reserves the right to refuse submissions, remove work from exhibition, suspend or terminate user accounts, or decline participation when necessary to protect the integrity, safety, reputation, or operation of the gallery and its programs.
13. Modifications to These Terms
PhotoPlace Gallery reserves the right to update or modify these Terms of Service at any time.
Changes will be posted on this page, and the date of the most recent revision will be indicated at the top of the document.
Continued use of the Site following the posting of revised Terms constitutes acceptance of those changes.

15. Governing Law
This Agreement and any disputes arising out of or relating to these Terms of Service shall be governed by and construed in accordance with the laws of the State of Vermont, without regard to its conflict of law principles.
You agree to submit to the exclusive jurisdiction of the state and federal courts located within the State of Vermont for any legal action arising out of or related to these Terms of Service.
